Terms of Sale
1. Overview
Welcome to Luminous Fine Art by Krasimir Ganchev! The terms “we”, “us” and “our” refer to Luminous Fine Art by Krasimir Ganchev (“Luminous Fine Art”). Luminous Fine Art operates this store and website, including all related information, content, features, tools, products and services (the “Services”). These Terms of Sale (the “Terms”) apply to purchases made from Luminous Fine Art. By placing an order, you agree to these Terms and to our Terms of Service and Privacy Policy.
2. Ordering
You are responsible for providing complete and accurate information at checkout—full name, billing and physical shipping address (no P.O. boxes), phone, valid email, and payment method.
Order changes are limited: (a) shipping‑address updates may be requested before the order ships; (b) cancellations are governed by 10. Cancellations and vary by product category; and (c) product specifications (image, size, finish, frame) cannot be modified after submission.
Luminous Fine Art may refuse or cancel any order at its discretion; if that occurs, your sole remedy is a refund of amounts paid for the canceled order.
3. Payment
Payment is due in full at checkout and your card is charged when you confirm your order. Accepted methods include major credit cards (Visa, Mastercard, American Express, Discover), Shop Pay, Apple Pay, Google Pay, Amazon Pay (and any additional methods we may introduce).
If payment is declined, reversed, or fails, we may cancel the order. If the order has shipped, the customer remains responsible for full payment. We may pursue collection, including reasonable attorneys’ fees, collection‑agency costs, and interest of 1.5% per month (or the maximum allowed by law, if lower).
4. Color & Materials
On‑screen colors may differ from final production due to display calibration, substrate, and process. Exact color matching to website previews is not guaranteed.
5. Personal Data
Order‑related information is governed by our Privacy Policy.
6. Taxes & Duties
You are responsible for all applicable sales, use, VAT/GST, excise, import duties, customs, and other taxes or fees. When we are required to collect such amounts, they will appear at checkout. If taxes were not collected and we are later assessed, you agree to promptly reimburse us.
7. Shipping, Handling & Insurance
Shipping, handling, and transit insurance are the customer’s responsibility and are billed at checkout (or invoiced separately for freight/oversize shipments). International orders may incur duties, VAT/GST, brokerage, and customs fees that are not included and are the customer’s responsibility (see “Taxes & Duties”).
Title and risk of loss pass to you when we deliver the order to the carrier. Shipments are insured while in transit; coverage ends once an order is delivered in good condition. When your order ships, you’ll receive a tracking link via email.
8. Production, Shipping & Delivery Timelines
- Fine Art Prints: made‑to‑order; allow 4–10 weeks for production plus carrier transit. Some large or oversize pieces may ship palletized (LTL); the carrier may schedule a delivery appointment and provide curbside service.
- Digital Downloads (e.g., digital books, gift cards): delivered electronically; no shipping. Access is typically available immediately after purchase (delivery email may take a few minutes).
- Retail Products (Non‑custom Goods): in‑stock items such as books, catalogs, calendars, postcards, note cards, apparel (e.g., tees, hats), small accessories (e.g., mugs, tote bags), cleaning kits, and similar goods typically ship within 1–3 business days, plus transit time.
Delivery estimates are not guarantees. Lead times may be extended during peak seasons, for complex specifications, or due to events outside our control (see “General”).
9. Damage in Transit & Claims
Inspect packages at delivery. For freight/LTL shipments, note any visible damage on the delivery receipt before signing. For concealed damage, notify us within 7 days of delivery and retain all original packaging; carriers may inspect and frequently deny claims if packaging is discarded.
- Keep all packaging (outer box/crate and internal materials).
- Photograph the outer box, inner packing, the artwork, and the shipping label/receipt.
- Notify the carrier promptly and obtain a claim/incident number.
- Contact us within 7 days of delivery with photos, your order number, and (if available) the carrier claim number.
Return Authorization Required. A Return Merchandise Authorization (RMA) from Luminous Fine Art is required for any return related to transit damage; returns without an RMA will be refused. Original packaging is required for claims; carriers commonly deny claims without it.
If we verify transit damage (and any required carrier inspection is complete), we’ll arrange return logistics and repair or replace the item at no charge. Claims received after 7 days may not be eligible.
10. Cancellations
- Fine Art Prints: production begins shortly after purchase; orders are non-cancelable, non-returnable, and non-refundable once in production.
- Digital Downloads (e.g., digital books, gift cards): final sale; not cancelable once the order is placed.
- Retail Products (Non‑custom Goods): may be canceled before shipment (contact us promptly with your order number). Once shipped, see 11. Returns.
11. Returns
- Fine Art Prints: final sale—no returns or exchanges. Each artwork is custom made to your specifications.
- Digital Downloads (e.g., digital books, gift cards): final sale—no cancellations or returns.
- Retail Products (Non‑custom Goods): returnable in like‑new, resalable condition within 14 days of receipt for store credit; the customer is responsible for return shipping.
12. Acceptance of Artwork
Because fine art is fragile, please inspect your artwork immediately upon receipt. If the artwork is damaged or nonconforming, notify us in writing within 7 days of delivery (see “Damage in Transit & Claims”). Otherwise, the artwork is deemed accepted.
13. Third‑Party Framing
You may frame locally; however, acrylic face‑mounted prints require specialized handling. We cannot accept responsibility for any damage (e.g., scratches, pressure marks, dust intrusion, delamination) that occurs during third‑party framing, installation, or handling. We offer in‑house, museum‑quality framing and can collaborate to source a custom frame if our standard options are not preferred (additional handling time; quotes on request).
14. Specifications & Approvals (Custom Work)
For custom framing or special specifications, we may require written or electronic approval of a final spec sheet or proof before production. Lead times begin after final approval and receipt of required payments. Changes after approval may incur additional charges and extend timelines.
15. Copyright & Reproduction
All copyrights and related rights (including reproduction and trade dress) in the artwork remain with the Artist and/or Luminous Fine Art. No copyright is sold or licensed. You may not reproduce, photograph, or otherwise copy the artwork without prior written permission. The Artist’s signature and/or copyright notice must not be removed or concealed.
16. Warranties & Disclaimers
Express Warranty of Authenticity (COA). Each qualifying fine art print includes a Certificate of Authenticity. The COA details (e.g., edition size) are an express warranty of authenticity under California’s Sale of Fine Prints law (Cal. Civ. Code § 1740 et seq.) and cannot be disclaimed.
All Other Warranties Disclaimed. Except for the express warranty of authenticity in the COA, all artworks, prints, frames, acrylic face-mounts, and accessories are sold AS-IS. To the maximum extent permitted by law, Luminous Fine Art, Krasimir Ganchev (the “Artist”), and our galleries, employees, representatives, and affiliates make no other express or implied warranties, including the implied warranties of merchantability or fitness for a particular purpose; no warranty arises from course of dealing, usage, or trade practice.
California consumers. If any non-waivable implied warranties apply, they are limited to the shortest period permitted by law and do not limit your statutory remedies for any inaccuracy in a COA. No oral or written statement outside the COA creates a warranty.
17. Limitation of Liability
To the maximum extent permitted by law, Luminous Fine Art will not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits or business interruption), even if advised of the possibility. Our total liability for any claim relating to a product you purchase is limited to the amount you paid for that product.
18. Indemnification
You agree to indemnify and hold harmless Luminous Fine Art and its personnel from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your misuse of the artwork; (b) damage caused by third‑party framing, installation, or handling; or (c) your violation of applicable law or these Terms.
19. Default & Remedies (if invoiced)
If you fail to pay amounts due or otherwise breach these Terms and do not cure within 10 days after written notice, we may suspend or cancel the order and pursue all available remedies, including retaining deposits, assessing interest as stated herein, and recovering reasonable collection costs and attorneys’ fees.
20. General
Product descriptions, images, specifications, availability, and pricing may change without notice. Current pricing appears on our site. We are not responsible for typographical errors and may correct them at any time. Orders are not binding until accepted. We may limit quantities, discontinue products, or impose conditions on promotions or discounts. We are not liable for delays or failures caused by events outside our control (including acts of God, war, terrorism, embargo/quarantine, fires, floods, severe weather, epidemics, labor or transport unavailability, or similar causes). You are responsible for proper handling and care after delivery.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. These Terms do not limit any rights that cannot be limited by law.
